These Terms of Service govern your use of the Deadstock AU website and the purchase of products through our online store. By accessing our website or placing an order, you agree to be bound by these terms. Please read them carefully before purchasing.

Deadstock AU is a trading name of E Lau Enterprises Pty Ltd (ABN: 52648647670). We are based in Sydney, New South Wales, Australia. References to "Deadstock AU", "we", "us" or "our" in these terms refer to E Lau Enterprises Pty Ltd trading as Deadstock AU.

2. Eligibility

By using this website and placing an order, you confirm that:

  • You are at least 18 years of age, or are purchasing under the supervision of a parent or legal guardian
  • You are legally capable of entering into a binding contract
  • You are purchasing for personal use or legitimate resale purposes, not for any unlawful purpose

3. Products

We sell trading card game products, sneakers, clothing, and related accessories. We take reasonable care to ensure all product descriptions, images, and pricing are accurate at the time of listing. However we reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice.

All sealed products are sold as received from our suppliers. Individual card singles are graded and described to the best of our ability using standard TCG condition guidelines (Near Mint, Lightly Played, Moderately Played, etc.).

4. Pricing & Payment

All prices displayed on our website are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable. We are registered for GST under Australian law.

We accept payment via the methods displayed at checkout, including Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, and Shop Pay. Payment is processed at the time of order. We reserve the right to cancel any order if payment cannot be verified or if a pricing error is identified.

We do not store your full payment details. All transactions are processed securely through our payment providers.

5. Orders & Acceptance

Placing an order constitutes an offer to purchase. Your order is not confirmed until you receive an order confirmation email from us. We reserve the right to refuse or cancel any order at our discretion, including but not limited to:

  • Products being out of stock after your order is placed
  • Pricing or description errors identified after purchase
  • Suspected fraudulent activity
  • Inability to verify payment

If we cancel your order, you will receive a full refund to your original payment method within 5 business days.

6. Shipping & Delivery

We ship from Sydney, New South Wales, Australia. Orders are dispatched within the processing timeframe stated on our Shipping Policy page. Delivery timeframes are estimates only and are not guaranteed — delays caused by Australia Post, courier services, weather, or other circumstances outside our control are not our responsibility.

Risk of loss and title for products pass to you upon dispatch from our facility. We strongly recommend reviewing your shipping address carefully before completing your order. We are not liable for orders delivered to an incorrectly provided address.

7. Returns & Refunds

Our returns and refund process is governed by our Refund Policy, which forms part of these Terms of Service. Please review our Refund Policy before purchasing.

In addition to our store policy, your rights under the Australian Consumer Law (ACL) are not affected by these terms. If a product is faulty, not as described, or does not do what it is supposed to do, you are entitled to a remedy under the ACL regardless of our store policy.

8. Sealed Products

By their nature, sealed trading card game products (booster packs, booster boxes, Elite Trainer Boxes, etc.) contain randomised contents. We make no representation or guarantee regarding the specific cards contained within any sealed product. The value of cards pulled from sealed product is not guaranteed. No refunds or exchanges will be provided based on the contents of opened sealed product.

9. Authenticity

All products sold by Deadstock AU are authentic. We do not knowingly sell counterfeit, altered, or misrepresented products. If you believe you have received a product that is not authentic, contact us immediately at help@deadstockau.com so we can investigate.

10. Intellectual Property

All content on the Deadstock AU website including text, images, logos, and design is the property of E Lau Enterprises Pty Ltd or is used with permission. You may not reproduce, distribute, or use any content from this website without our prior written consent.

Pokémon and all related names and images are trademarks of Nintendo, Creatures Inc., and GAME FREAK inc. We are an independent retailer and are not affiliated with, endorsed by, or sponsored by The Pokémon Company or Nintendo.

11. Limitation of Liability

To the maximum extent permitted by law, Deadstock AU and E Lau Enterprises Pty Ltd shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our website or products purchased from us. Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the relevant product.

Nothing in these terms limits your rights under the Australian Consumer Law.
